Terms of Service
These Terms of Service ("Terms") govern access to and use of the Maz platform — including the Maz mobile applications and the website mazmobility.com (together, the "Services") — operated by SHIPZY SARL ("SHIPZY", "we", "us", or "our"), a limited liability company organized under the laws of the Kingdom of Morocco, registered with the Commercial Register of Tanger under n° 176027 (ICE 003956906000017). By registering for, accessing, or using the Services, you agree to be bound by these Terms.
1. The Service
Maz is a business-to-business (B2B) marketplace on which verified professional car dealers list vehicles, obtain professional vehicle inspections, and buy and sell vehicles through real-time auctions. SHIPZY provides the platform and related services; except where expressly stated, SHIPZY is not a party to the sale contract formed between a selling dealer and a winning bidder.
2. Eligibility and Accounts
- The Services are available only to professional car dealers and their authorized representatives. The Services are not offered to consumers or private individuals.
- Registration requires verification of your identity and dealer status. You must provide accurate, complete, and current information and keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
- SHIPZY may approve, refuse, suspend, or terminate accounts at its reasonable discretion, including for breach of these Terms or suspected fraud.
3. Listings and Inspections
- Selling dealers must provide truthful and accurate vehicle information and photos, and must have the legal right to sell each listed vehicle.
- Listed vehicles are assessed by an inspector, and an inspection report is made available to prospective bidders. Inspection reports reflect the vehicle's observed condition at the time of inspection and are provided for information; they do not constitute a warranty by SHIPZY.
- SHIPZY may reject, edit, or remove any listing that is inaccurate, unlawful, or otherwise in breach of these Terms.
4. Auctions and Bidding
- Bids are binding. Each bid constitutes a firm offer to purchase the vehicle at the bid amount. If you are the winning bidder when an auction closes, you are obligated to complete the purchase.
- Auctions run in real time. Closing times may be automatically extended by anti-sniping rules when bids are placed near the end of an auction.
- Bid manipulation of any kind — including shill bidding, collusion, or interference with the bidding process — is strictly prohibited.
- SHIPZY may cancel or void an auction in cases of technical failure, error, fraud, or breach of these Terms.
5. Fees and Payments
- Use of the Services may be subject to fees, including inspection fees and transaction or success fees, communicated to you on the platform.
- Winning dealers must settle payment obligations within the timeframes indicated in their task inbox on the platform. Overdue obligations may result in suspension of bidding privileges or of the account.
- All amounts are stated in Moroccan Dirhams (MAD) unless otherwise indicated. Fees are non-refundable except where required by law or expressly stated otherwise.
6. Vehicle Handover
Following payment, the selling dealer and winning dealer complete the vehicle handover and the transfer of ownership documents in accordance with applicable Moroccan law. Each party is responsible for its own legal, tax, and registration obligations arising from the sale.
7. Prohibited Conduct
You must not:
- provide false, misleading, or fraudulent information, listings, or documents;
- circumvent the platform to complete off-platform transactions initiated on Maz for the purpose of avoiding fees;
- interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Services or their systems;
- use the Services in violation of any applicable law or regulation; or
- use automated means to access the Services without our prior written permission.
8. Intellectual Property
The Services, including the Maz name, logo, software, and content (excluding content submitted by dealers), are owned by SHIPZY SARL and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services for your professional dealer activity. By submitting listing content, you grant SHIPZY a worldwide, royalty-free license to host, display, and reproduce that content for the purpose of operating and promoting the Services.
9. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, SHIPZY disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. SHIPZY does not warrant the accuracy or completeness of listings or inspection reports, that the Services will be uninterrupted or error-free, or that any vehicle will meet your expectations.
10. Limitation of Liability
To the fullest extent permitted by law, SHIPZY SARL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to the Services. SHIPZY's aggregate liability for all claims arising out of or related to the Services shall not exceed the total fees paid by you to SHIPZY in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Suspension and Termination
You may stop using the Services and request closure of your account at any time. SHIPZY may suspend or terminate your access to the Services, with notice where practicable, for breach of these Terms, fraudulent or unlawful activity, unpaid obligations, or risk to the platform or other users. Provisions that by their nature should survive termination (including payment obligations, intellectual property, disclaimers, and limitations of liability) survive.
12. Changes to the Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date and, for material changes, notify you through the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the Kingdom of Morocco. Any dispute arising out of or relating to these Terms or the Services shall be submitted to the competent courts of Tanger, Morocco, without prejudice to any mandatory jurisdiction provisions of applicable law.
